How does an Uncontested Divorce Work?
A divorce can be contested or it can be uncontested. If it’s contested there are lots of different variations to how it’s contested or how hard it’s contested. Let me talk a minute about uncontested divorces. In uncontested divorces where you and your spouse agree before anything is filed, before a petition is filed, you and your spouse sit down and agree as to how everything should be handled, how all the assets and liabilities should be distributed. If there are children, you agree to a parenting plan. You agree to everything and you do a marital settlement agreement before filing and you sign the marital settlement agreement and file it along with the filing of the petition for dissolution of marriage. This is a truly uncontested divorce and the one spouse who doesn’t file will sign an answer and a waiver and the divorce will go through very quickly.
